1. Acceptance of Terms
By accessing or using Spimov ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Spimov.
If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
Spimov is an AI-powered video dubbing platform that enables users to dub video content into multiple languages using voice cloning, speech synthesis, lip synchronization, and subtitle generation technologies.
The Service is provided on a subscription basis with tiered plans. Feature availability varies by plan. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. Accounts & Eligibility
3.1 Eligibility
You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@spimov.com of any unauthorized use of your account.
3.3 One Account per User
Each user may maintain only one free account. Creating multiple accounts to circumvent usage limits is prohibited and may result in termination of all associated accounts.
4. Subscriptions & Billing
4.1 Plans & Pricing
Paid subscription plans are billed monthly or annually in advance. Current pricing is displayed on the Pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers.
4.2 Usage Limits
Each plan includes a monthly processing quota (minutes of video). Unused quota does not roll over to the next billing period. Exceeding your plan's quota requires an upgrade.
4.3 Automatic Renewal
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel at any time through your account settings.
4.4 Payment
Payments are processed by Stripe. You authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as stated in the Refund Policy.
4.5 Taxes
Prices shown do not include applicable taxes. You are responsible for any taxes, duties, or levies imposed by your local jurisdiction.
5. Content & Intellectual Property
5.1 Your Content
You retain all ownership rights to the video content you upload ("Your Content"). By uploading content, you grant Spimov a limited, non-exclusive, worldwide license to process, store, and transform Your Content solely for the purpose of delivering the Service to you.
5.2 Content Responsibility
You represent and warrant that: (a) you own or have the necessary rights to upload Your Content; (b) Your Content does not infringe any third-party intellectual property rights; (c) Your Content complies with all applicable laws.
5.3 Output Content
Dubbed output files generated from Your Content are owned by you. Spimov claims no ownership over your output files.
5.4 Spimov IP
The Service, including its software, AI models, design, and documentation, is owned by Spimov and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
5.5 Data Deletion
Source videos and output files are retained for 30 days after job completion, after which they are automatically deleted. You are responsible for downloading your output files within this window.
6. Prohibited Uses
You agree not to use the Service to:
- Create deepfakes, non-consensual intimate imagery, or content designed to deceive or defraud
- Infringe copyright, trademarks, or other intellectual property rights of third parties
- Generate content that is unlawful, hateful, threatening, harassing, defamatory, or obscene
- Spread misinformation or manipulate political discourse
- Violate the privacy or personal rights of any individual
- Circumvent usage limits through automation, scraping, or multiple accounts
- Attempt to access or probe the underlying AI models, infrastructure, or source code
- Resell or sublicense access to the Service without prior written agreement
Violation of these prohibitions may result in immediate account termination and, where applicable, legal action.
7. Third-Party Services
The Service integrates with third-party providers including Stripe (payments), YouTube (optional publishing), Cloudflare (CDN/security), and cloud GPU providers. Your use of these integrations is subject to the respective providers' terms of service. Spimov is not responsible for the acts or omissions of third-party services.
8. Disclaimers & Limitation of Liability
8.1 No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 AI Accuracy
AI-generated dubbing, transcription, and translation outputs may contain errors. Spimov makes no guarantee of accuracy, and you are responsible for reviewing outputs before publication.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIMOV'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SPIMOV IN THE THREE MONTHS PRECEDING THE CLAIM. SPIMOV SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Termination
You may terminate your account at any time by cancelling your subscription and deleting your account from settings. We may suspend or terminate your account immediately if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. Sections 5.4, 8, and 10 survive termination.
10. Governing Law
These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey. If you are a consumer in the EU, mandatory consumer protection laws of your country of residence also apply.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or prominent notice within the Service at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
